{"id":1809,"date":"2025-06-22T20:00:48","date_gmt":"2025-06-22T20:00:48","guid":{"rendered":"https:\/\/tmbglobal.news\/index.php\/2025\/06\/22\/fasorp-sues-michigan-law-review-over-editor-selection-processes\/"},"modified":"2025-06-22T20:00:51","modified_gmt":"2025-06-22T20:00:51","slug":"fasorp-sues-michigan-law-review-over-editor-selection-processes","status":"publish","type":"post","link":"https:\/\/tmbglobal.news\/index.php\/2025\/06\/22\/fasorp-sues-michigan-law-review-over-editor-selection-processes\/","title":{"rendered":"FASORP sues Michigan Law Review over editor selection processes"},"content":{"rendered":"<p><\/p>\n<div>\n<p>T<em>his is a developing story and will be updated as more information becomes available.<\/em><\/p>\n<p><a href=\"https:\/\/fasorp.org\/\">Faculty, Alumni, &amp; Students Opposed to Racial Preferences<\/a>, represented by <a href=\"https:\/\/aflegal.org\/\">America First Legal<\/a>, filed a <a href=\"https:\/\/media.aflegal.org\/wp-content\/uploads\/2025\/06\/19114605\/FASORP-v.-Michigan-Law-Review-Association-Lawsuit.pdf\">federal lawsuit<\/a> Wednesday against the <a href=\"https:\/\/michiganlawreview.org\/\">Michigan Law Review<\/a>, several of its editors and the University of Michigan as a whole, alleging discrimination in how MLR selects its members and articles. According to the lawsuit, 40% of Michigan Law Review applicants are chosen purely on test scores without consideration of personal identity. The rest, however, are chosen through a holistic process which includes a personal statement, which FARSOP claims is vulnerable to bias.<\/p>\n<p>\u201cThe remaining 60% of the new student members are chosen through a process that the Law Review calls \u201cholistic review,\u201d in which the Law Review considers an applicant\u2019s mini-note, bluebook exercise, note proposal, first-year grades, and personal statement,\u201d the lawsuit reads. \u201cBut there is no fixed or announced formula for weighing these five different factors, or for deciding which students will be accepted through this \u201cholistic review\u201d process. Instead, the members of the Law Review\u2019s \u201cHolistic Review Committee\u201d have unfettered discretion to decide how these five factors will be weighted for each particular applicant\u2026\u201d<\/p>\n<p>The lawsuit alleges that MLR\u2019s holistic review process for selecting editors and articles is discriminatory against heterosexual, white and Asian applicants, who FASORP says are more qualified than some of the minority applicants chosen over them.\u00a0<\/p>\n<aside class=\"scaip scaip-1    \">\n\t\t<\/aside>\n<p>\u201cWhen the members of the Holistic Review Committee grade the personal statements and decide which applicants to accept, they award illegal and discriminatory preferences to applicants who indicate in their personal statements that they are female, members of an \u201cunderrepresented\u201d (i.e., nonAsian) racial minority, homosexual, or transgender,\u201d the lawsuit reads. \u201cApplicants from these preferred demographics receive higher scores on the personal statement than they would have received had they chosen not to flag these demographic characteristics in their personal statements. Applicants from these preferred demographics are also awarded positions on the Law Review over heterosexual and non-transgender white men who have better grades and better scores on the components of the Law Review\u2019s writing competition.\u201d<\/p>\n<p>The lawsuit also claims students who have or have had conservative affiliations, such as members of <a href=\"https:\/\/www.michiganlawfedsoc.com\/\">The Federalist Society<\/a>, are excluded from MLR\u2019s Holistic Review Committee in order to prevent information regarding selection processes from being released to the public.<\/p>\n<p>\u201cThe Law Review\u2019s use of race and sex preferences in the grading of personal statements and the holistic-review process is a flagrant violation of state and federal anti-discrimination law,\u201d the lawsuit reads. \u201cStudents who are believed to be conservative or members of organizations such as the Federalist Society are never chosen to serve on the Holistic Review Committee and are never chosen for editorial positions that entail a place on the Holistic Review Committee, because these students would resist or expose the Law Review\u2019s use of illegal race and sex preferences when selecting student members.\u201d\u00a0<\/p>\n<p>FASORP is bringing the case on behalf of three unnamed white heterosexual male law professors who have had their articles rejected from MLR and an unnamed white male law student who has applied to become a member of MLR. This is not FASORP\u2019s first lawsuit against review journals at universities. FASORP also has a <a href=\"https:\/\/fasorp.org\/static\/fasorp\/pdf\/NW-Complaint-202502.faae293df18f.pdf\">pending lawsuit<\/a> against the Northwestern University Law Review regarding discrimination in selection processes.<\/p>\n<p>Gene Hamilton, president of America First Legal, wrote in a <a href=\"https:\/\/aflegal.org\/america-first-legal-sues-the-university-of-michigan-and-the-michigan-law-review-association-for-illegal-racial-discrimination\/\">press release<\/a> this lawsuit is a part of the AFL\u2019s fight to end racial discrimination in academia.\u00a0<\/p>\n<aside class=\"scaip scaip-2    \">\n\t\t<\/aside>\n<p>\u201cDespite clear law on point prohibiting such discrimination and numerous Supreme Court decisions, racial discrimination continues to be pervasive throughout academia,\u201d Hamilton said. \u201cAFL will not tolerate this unconstitutional discrimination at the University of Michigan and is taking decisive action to restore meritocracy and protect American values.\u201d<br \/><em>Summer News Editor Alyssa Tisch can be reached at <\/em><a href=\"https:\/\/www.michigandaily.com\/news\/news-briefs\/fasorp-sues-michigan-law-review-over-editor-selection-processes\/mailto:tischaa@umich.edu\"><em>tischaa@umich.edu<\/em><\/a><em>.<\/em><\/p>\n<aside>\n\t\t<\/aside>\n<p><h3 class=\"jp-relatedposts-headline\"><em>Related articles<\/em><\/h3>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>This is a developing story and will be updated as more information becomes available.
