{"id":2695,"date":"2025-09-13T02:49:04","date_gmt":"2025-09-13T02:49:04","guid":{"rendered":"https:\/\/tmbglobal.news\/index.php\/2025\/09\/13\/umich-visiting-scholar-sentenced-to-time-served-for-smuggling-case\/"},"modified":"2025-09-13T02:49:08","modified_gmt":"2025-09-13T02:49:08","slug":"umich-visiting-scholar-sentenced-to-time-served-for-smuggling-case","status":"publish","type":"post","link":"https:\/\/tmbglobal.news\/index.php\/2025\/09\/13\/umich-visiting-scholar-sentenced-to-time-served-for-smuggling-case\/","title":{"rendered":"UMich visiting scholar sentenced to time served for smuggling case"},"content":{"rendered":"<p><\/p>\n<div>\n<p>On Wednesday, Chengxuan Han, University of Michigan visiting scholar from the Huazhong University of Science and Technology, was <a href=\"https:\/\/www.justice.gov\/usao-edmi\/pr\/alien-wuhan-china-sentenced-smuggling-biological-materials-us-her-work-university\">sentenced to her time served<\/a> \u2014 a total of three months in jail \u2014 and will return to China after pleading <a href=\"https:\/\/www.cbsnews.com\/detroit\/news\/chinese-national-accused-smuggling-biological-materials-into-michigan-pleads-no-contest\/\">no contest<\/a> in August to three <a href=\"https:\/\/www.michigandaily.com\/news\/news-briefs\/umich-visiting-scholar-arrested-charged-with-smuggling-roundworm-material\/\">smuggling charges<\/a> and to making false statements to United States Custom and Border Protection officers.\u00a0<\/p>\n<p>The sentence comes after Han was arrested at the Detroit Metropolitan Wayne County Airport in June <a href=\"https:\/\/michiganadvance.com\/2025\/06\/10\/chinese-national-with-university-of-michigan-ties-charged-for-smuggling-bio-material-into-u-s\/\">for lying to Border Protection<\/a> about packages that she had previously sent to individuals associated with a U-M lab in 2024 and 2025. The packages contained a growth medium used in the cultivation of <a href=\"https:\/\/nematology.ucr.edu\/about\/what-are-nematodes\">nematodes<\/a> \u2014 a kind of roundworm \u2014 as well as DNA material.\u00a0<\/p>\n<p>The <a href=\"https:\/\/internationalcenter.umich.edu\/isss\/scholars\">Exchange Visitor Program<\/a> at the University is meant to promote international educational and cultural exchange between professors, researchers, short-term scholars and specialists who are given the opportunity to study and work at the University. Any researcher who comes to the University is <a href=\"https:\/\/research.umich.edu\/research-resources\/research-security-and-compliance\/\">required to comply<\/a> with both federal and University regulations when handling biological material.\u00a0<\/p>\n<p>Han\u2019s defense attorneys, Sara Garber and Benton Martin, said in the <a href=\"https:\/\/www.scribd.com\/document\/915041308\/DEFENSE-Sentencing-Memo-USA-v-Han#fullscreen&amp;from_embed\">sentencing memorandum<\/a> that the government\u2019s accusations are misguided, as Han routinely sends and receives packages with biological materials across the world, and the government overstated the seriousness of Han\u2019s actions.\u00a0<\/p>\n<aside class=\"scaip scaip-1    \">\n\t\t<\/aside>\n<p>\u201cEven if Ms. Han was negligent or failed to obtain the proper paperwork required by the United States for shipping materials\u2014she made a mistake,\u201d the memorandum read. \u201cA mistake she has absolutely taken to heart and learned from. She did not, however, commit a criminal offense as charged by the government, certainly not with knowledge she was violating the law or with the intent to defraud the government.\u201d\u00a0\u00a0<\/p>\n<p>Garber and Martin also highlighted that Han has no criminal history and requested a sentence of time served.\u00a0<\/p>\n<p>\u201cMs. Han has no criminal history,\u201d the memorandum read. \u201cAs to deterrence, either general or individual, we know that the likelihood of being caught is a greater deterrence than any term of imprisonment.
