{"id":3981,"date":"2025-12-17T12:49:03","date_gmt":"2025-12-17T12:49:03","guid":{"rendered":"https:\/\/tmbglobal.news\/index.php\/2025\/12\/17\/saline-township-resident-takes-legal-action-to-stop-data-center\/"},"modified":"2025-12-17T12:49:07","modified_gmt":"2025-12-17T12:49:07","slug":"saline-township-resident-takes-legal-action-to-stop-data-center","status":"publish","type":"post","link":"https:\/\/tmbglobal.news\/index.php\/2025\/12\/17\/saline-township-resident-takes-legal-action-to-stop-data-center\/","title":{"rendered":"Saline Township resident takes legal action to stop data center"},"content":{"rendered":"<p><\/p>\n<div>\n<p>Saline Township resident Kathryn Haushalter filed <a href=\"https:\/\/cryptpad.fr\/drive\/#\/2\/drive\/view\/WQAYOjbQjWdVT-cF0YpkN5RF40Cc85QZtRzwqwNGvAQ\/\">court papers<\/a> Dec. 13 to intervene in an ongoing lawsuit between Saline Township and <a href=\"https:\/\/www.datacentermap.com\/c\/related-digital\/\">Related Digital<\/a>, a data center development company, over <a href=\"https:\/\/openai.com\/index\/announcing-the-stargate-project\/\">Stargate<\/a>, a <a href=\"https:\/\/www.michigandaily.com\/news\/business\/openai-data-center-planned-for-farmland-in-saline\/\">proposed<\/a> $7 billion data center. The development is backed by tech company <a href=\"https:\/\/www.oracle.com\">Oracle<\/a> and <a href=\"https:\/\/openai.com\">OpenAI<\/a>.\u00a0<\/p>\n<p>If constructed, the facility would become the <a href=\"https:\/\/static1.squarespace.com\/static\/67b7da12110cf104f1b5ac82\/t\/68d13aadd5f61372636f0ba9\/1758542509907\/Washtenaw%2BData%2BCenter%2BFAQ%2BSep%2B21%2B4pm.pdf\">largest data center<\/a> in the United States, spanning 2.2 million square feet across 575 acres of land in Saline Township with an additional 476 acres in neighboring Bridgewater Township. Related Digital sued Saline Township after officials voted to <a href=\"https:\/\/planetdetroit.org\/2025\/09\/saline-denies-data-center\/\">deny<\/a> rezoning the area needed for the project, alleging the decision violated the Michigan Constitution\u2019s <a href=\"https:\/\/www.legislature.mi.gov\/Laws\/MCL?objectName=mcl-act-110-of-2006\">ban<\/a> on exclusionary zoning.\u00a0<\/p>\n<p>Haushalter filed a <a href=\"https:\/\/trellis.law\/motion-type-dictionary\/what-is-a-motion-to-intervene-complaint-in-intervention-28\">motion to intervene<\/a> in the <a href=\"https:\/\/www.washtenaw.org\/1609\/Washtenaw-County-Courts\">Washtenaw County Circuit Court<\/a>, challenging\u00a0 an Oct 15. <a href=\"https:\/\/legalclarity.org\/what-is-the-meaning-of-a-consent-judgment-in-legal-terms\/\">consent judgment<\/a> \u2014 an out-of-court settlement reached between the township Related Digital \u2014 and alleging township officials violated Michigan\u2019s <a href=\"https:\/\/www.legislature.mi.gov\/documents\/mcl\/pdf\/mcl-act-267-of-1976.pdf\">Open Meetings Act<\/a> during the agreement\u2019s approval process.\u00a0<\/p>\n<p>In a <a href=\"https:\/\/www.stopsalinedatacenter.org\/legal\/Blog%20Post%20Title%20One-3zaa9-zlxng-67tfc-8aja7\">statement<\/a>, Haushalter said the <a href=\"https:\/\/salinetownship.org\/board-members\">Saline Township Council<\/a> violated the act by holding a closed session approval vote on the final settlement language Oct.1.<\/p>\n<aside class=\"scaip scaip-1    \">\n\t\t<\/aside>\n<p>\u201cOur township board had no right to vote secretly and usher in a predatory data center in the middle of our farmland community through unlawful rezoning,\u201d Haushalter wrote. \u201cWe will now stand with the citizens of Saline Township and fight for our right to say \u2018no\u2019 to this project.\u201d<\/p>\n<p>Saline Township attorney Fred Lucas and Clerk Kelly Marion told <a href=\"https:\/\/planetdetroit.org\/2025\/12\/saline-data-center-settlement-challenge\/\">Planet Detroit<\/a> the vote to move forward with the settlement was held at a packed meeting. However, they said clerical error in the <a href=\"https:\/\/salinetownship.org\/uploads\/minutes\/1760634637_Special%20Meeting%20October%201%20%202025%20Minutes.pdf\">meeting minutes<\/a> makes it appear as though it was done in a closed session.<\/p>\n<p>In a <a href=\"https:\/\/www.stopsalinedatacenter.org\/legal\/Blog%20Post%20Title%20One-3zaa9-zlxng-67tfc-8aja7\">public statement<\/a>, Robby Dube, one of Haushalter\u2019s attorneys, wrote the consent judgment is invalid because only two of the five-member board signed the final version when it was filed with the court Oct. 15., which he alleges is also a violation of the Open Meetings Act.\u00a0<\/p>\n<p>\u201cWe have filed to intervene into the Saline lawsuit so we can throw out the consent judgment that was negotiated and signed in secret,\u201d Dube wrote. \u201cThen, we will do what Saline Township was unwilling to do: fight to show the original decision to deny rezoning was valid. Data centers cannot be permitted to use lawfare to override the democratic will of the people.\u201d<\/p>\n<p>In a <a href=\"https:\/\/www.michigan.gov\/whitmer\/news\/press-releases\/2025\/10\/30\/whitmer-on-stargate-announcement-from-openai-oracle-related-digital-creating-thousands-of-jobs\">press release<\/a> issued Oct. 30, Gov. Gretchen Whitmer publicly supported the project, calling it the <a href=\"https:\/\/michiganadvance.com\/2025\/10\/30\/whitmer-multi-billion-dollar-saline-township-data-center-largest-investment-in-michigan-history\/\">largest one-time investment<\/a> in Michigan\u2019s history and highlighting its ability to create thousands of jobs.\u00a0\u00a0<\/p>\n<aside class=\"scaip scaip-2    \">\n\t\t<\/aside>\n<p>\u201cThis transformational new Stargate OpenAI facility, built by Oracle and Related Digital, will create 2,500 good-paying union construction jobs, more than 450 permanent high-skill, high-paying jobs on site, and 1,500 more in the community while helping us lead the future of advanced manufacturing and technology,\u201d Whitmer wrote.\u00a0<\/p>\n<p>Whitmer expressed her growing support and wrote the investment will position Michigan as a national leader in artificial intelligence infrastructure.<\/p>\n<p>\u201cWe will continue working together at the state level to win more projects so we can create even more good-paying, local jobs for Michiganders and grow our economy,\u201d Whitmer wrote. \u201cThis investment from Oracle and Related Digital sends a simple message to anyone who wants to build the future\u2014you can build it in Michigan.\u201d<\/p>\n<p>The lawsuits have support from activist groups like <a href=\"https:\/\/www.stopsalinedatacenter.org\">Stop the Saline Data Center<\/a> and the <a href=\"https:\/\/www.stopsalinedatacenter.org\/rmdf\">Rural Michigan Defense Fund.<\/a>\u00a0<\/p>\n<p>The court will decide whether to allow Haushalter to join the lawsuit formally.
